El cliente, para todos los productos hardware ofrecidos en nuestra tienda y una vez recibidos en su casa(1), dispone de 14 días naturales en los que puede evaluarlos y considerar desestimar la compra con la consiguiente devolución de su dinero. El cliente se hará cargo del envío del producto a nuestras instalaciones y tras una evaluación del mismo, procederemos a una devolución completa o parcial (si el producto ha sufrido algún tipo de daños) de la cantidad que se pagó por la compra de estos productos.

(1) CONDICIONES DE ENTREGA

No puedes aceptar la recepción de ningún pedido si ves que la caja presenta defectos tales como fisuras, rajas, golpes o percibes que el producto está abierto, manipulado o en mal estado. En casos como este, lo que debes es comunicar al repartidor que rechazas esa entrega, y en el albarán que te de, especificar por escrito que rechazas el pedido por aquellos motivos. Igualmente, debes notificarnos esta circunstancia dentro de las siguientes 24 horas, a través de un correo electrónico dirigido a support@msxvr.com.

Si aceptas cualquier paquete en tales condiciones, pierdes cualquier posibilidad de reclamación, ya que nosotros no somos responsables de los posibles daños que los pedidos sufran durante su fase de envío.

(2) GARANTÍA

Así mismo, los productos hardware ofrecidos en la tienda, disponen de una garantía de tres años una vez se reciben en casa del cliente. En el caso de que ocurra algún tipo de avería que requiera de ser revisada en nuestras instalaciones, el cliente se hará cargo de hacernos llegar el producto, nosotros evaluaremos el tipo de avería y determinaremos si ha sido responsabilidad nuestra o del cliente. Por supuesto, detallaremos toda la información al cliente y este decidirá entre las posibles soluciones que le podamos ofrecer. Si la avería es responsabilidad del cliente porque ha sido quien la ha provocado, tendrá que hacerse cargo de los costes de la reparación. En cualquiera de los casos, los gastos de envío siempre corren por cuenta del cliente.

Productos no tangibles, digitales. Producto software.

Ejemplos: Videojuego con descarga digital.

El cliente ha de tener en cuenta que no se admitirán devoluciones para este tipo de producto software. Una vez realizada la compra, el cliente dispondrá de un archivo digital compatible con las especificaciones que indique el producto y del cual podrá hacer tantas copias como crea conveniente, siempre que sean para uso privado y como copia de respaldo.

VIKALB PROGRAMMING concede, y usted acepta, una licencia limitada, rescindible y no exclusiva y el derecho de utilizar el software para su uso personal sin fines comerciales.

La licencia de este producto software le permitirá adquirir de forma gratuita, cualquiera de las actualizaciones que se puedan publicar con el fin de solucionar o mejorar problemas de funcionalidad.

CONDICIONES DE APLICACIÓN

La Ley General para la Defensa de los Consumidores y Usuarios (Real Decreto Legislativo 1/2007, de 16 de noviembre) en su Artículo 2 (Concepto general de consumidor y de usuario) indica que : «A efectos de esta norma y sin perjuicio de lo dispuesto expresamente en sus libros tercero y cuarto, son consumidores o usuarios las personas físicas o jurídicas que actúan en un ámbito ajeno a una actividad empresarial o profesional.«, por lo que las compras realizadas por personas jurídicas (empresas, sociedades, etc.) realizadas como tal no están amparadas por dicha Ley y por lo tanto algunas o todas las condiciones indicadas en esta sección no les serán de aplicación.

CONDICIONES DE DEVOLUCIONES PARAR CLIENTES PARTICULARES

Hay casos en que la posibilidad de que nos devuelvas el producto que compraste no se aplica. Sabemos que los textos legales son farragosos, pero tenemos que informarte de que esos supuestos los recoge la Ley 47/2002 de 19 de diciembre, que reforma la Ley 7/1996, de 15 de enero de Ordenación del Comercio Minorista. A través de esa reforma, nuestro ordenamiento jurídico incorporó las disposiciones de la Directiva 97/7/CE, en materia de contratos a distancia y se adaptó a la normativa comunitaria.

Los supuestos que mencionamos en el párrafo anterior y que quedan excluidos de ejercer el derecho de desistimiento son los siguientes:

Por motivos de higiene personal no se admitirá la devolución de ninguno de los siguientes productos si han sido desprecintados o se detectan los más mínimos signos de uso y/o configuración.
Productos con signos evidentes de uso o manipulación más allá de lo indispensable para verificar la idoneidad del producto, ralladuras, roces o cualquier tipo de desperfecto o cuyo número de serie haya sido alterado, eliminado o despegada cualquier tipo de etiqueta o marcaje que incluya de serie.
Productos que no incluyan todos los embalajes, documentación, accesorios, drivers, CD’s, cables, regalos asociados, etc. que le fueron enviados junto con el producto original y en perfecto estado.
Productos que incluyan algún tipo de código promocional o servicio asociado que haya sido desprecintado o usado por el cliente.
Todo tipo de Software, juegos para consolas, DVD, Blu-ray, TDT de pago cuyo precinto/embalaje haya sido dañado o abierto.
Todo tipo de portátiles y ordenadores de sobremesa que no se devuelvan en las mismas condiciones de la entrega.
Los productos digitales, por su naturaleza, no admiten devolución una vez confirmada la compra.

Para realizar una devolución debes contactarnos enviándonos un email a: support@msxvr.com, exponiendo los motivos por los que quieres devolver el producto o productos.

Toda mercancía debe ser devuelta en perfecto estado y en un embalaje que asegure su protección, en aras de garantizar que el producto no sufra daños durante su transporte a nuestras instalaciones.

Las devoluciones deben ser entregadas en destino dentro de los 14 días posteriores a la fecha de aceptación de la devolución. En caso contrario será rechazada y devuelta.

Una vez recibida la mercancía y comprobada que está en perfectas condiciones, se tramitará la devolución del importe si así es indicado.

En caso de desistimiento parcial de un pedido, los gastos de envío correspondientes a dicho pedido se reembolsarán proporcionalmente a los artículos afectados por este desistimiento.

Los gastos de transporte originados por la devolución correrán a cargo del cliente.

Los abonos vía transferencia bancaria por devoluciones tendrán un plazo máximo de 14 días por trámites administrativos, aunque intentamos que no se demoren más de 7 días.

CONDICIONES DE DEVOLUCIONES PARA EMPRESAS

Únicamente se aceptarán devoluciones de material sin desprecintar y en perfecto estado, durante los 14 días posteriores a su recepción.

Tales devoluciones serán tramitadas como devolución comercial, ya que no hay ninguna ley que regule los derechos de devolución entre empresas y dichas tramitaciones están reguladas según las condiciones de VIKALB PROGRAMMING.

Los productos en blíster o termo sellado, y resto de productos que presenten un precinto de fábrica de seguridad roto, no podrán devolverse.

Dichas condiciones no anulan el derecho de garantía o cambio de productos defectuosos según estipula la garantía del fabricante. VIKALB PROGRAMMING se reserva el derecho de denegar la devolución en caso de detectarse cualquier anomalía en el producto devuelto.

CANCELACIONES DE PEDIDO

Las cancelaciones de pedidos que impliquen una devolución al cliente y que tengamos que tramitar por transferencia bancaria, tendrán un plazo máximo de ejecución de 30 días debido a trámites administrativos, pero siempre intentamos que el plazo no sea superior a 7 días.

ENVÍOS

Tienes 24 horas para comprobar la integridad de todos los componentes de tu pedido, y para verificar que dispone de todo lo que debe incluir en cada producto. Pasadas estas 24 horas, entendemos que has aceptado tu pedido y estás conforme con los productos recibidos, por lo que no podremos asumir reclamaciones por desperfectos o fallos durante el envío.

Se considerará entregado un pedido cuando hayas firmado el recibo de entrega. Es en las siguientes 24 horas cuando debes verificar los productos tal como te hemos comentado más arriba, y exponer todas las objeciones que pudiesen existir.

Toda mercancía debe ser devuelta en su embalaje original, en perfecto estado y protegido de forma que no se reciba con precintos o cintas adhesivas de transporte. En caso contrario VIKALB PROGRAMMING se reserva el derecho de rechazar la devolución.

Una vez recibida la mercancía en nuestras instalaciones y comprobada que está en perfectas condiciones, se tramitará la devolución del importe si así es indicado.

Importante: si el operador logístico no puede realizar la entrega de tu pedido bien porque la dirección que facilitaste durante el proceso de compra es incorrecta o te faltaron datos por añadir y la empresa de transporte no tiene cómo encontrar la ubicación, o bien por ausencias reiteradas en el lugar de entrega, si quieres cancelar tu pedido, te abonaremos el importe, descontando en todo caso los portes y gastos logísticos derivados de esos intentos frustrados de entrega. Asegúrate de incluir la información de tu domicilio o punto de entrega incluyendo todos los datos necesarios para que la empresa de transporte pueda realizar la entrega y de devolver la llamada que no hayas podido atender en los días previstos de entrega; presumiblemente será la compañía de transporte tratando de acordar contigo una nueva fecha u horario de entrega.
